ROYAL HOTEL - STANDARD TERMS AND CONDITIONS OF BUSINESS FOR GROUP RESERVATIONS              

                                     
This agreement constitutes an agreement between The Royal Hotel (Stornoway) Ltd  (hereinafter “the hotel”) and you the contracted operator or wholesaler (hereinafter “the operator”).                                                    
1.        DEFINITION. Throughout these Terms of Business (‘terms’) ‘we’, ‘our’, ‘us’ refer to Royal Hotel (Stornoway) Ltd, ‘You’, ‘your’ etc. refer to the company, partnership or other entity who places and/or operates the group reservation.                             

2.        PROPER LAW. All contracts between you and us will include the terms stated here and will be governed according to Scottish Law. Any dispute will be under jurisdiction of the Scottish Courts. Should any part of the terms herein found to be invalid or unenforceable, and then the remaining terms will not be affected but will remain enforceable. Failure by Royal Hotel (Stornoway) Lt to enforce any of the provisions shall not be constructed as a waiver of its rights nor affect the validity of the agreement nor prejudice Royal Hotel (Stornoway) Ltd as regards subsequent action.    
                                    
3.        CONFLICTING TERMS. It is your responsibility to bring to our attention any standard terms which conflicts with our terms, save that in any event these terms shall prevail over any such terms of your own.                                        
                                        
4.        THE CONTRACT is formed on the date of issue of our confirmation to you of your hotel reservation which includes or refers to these terms and states your written requirements accommodation and services.                                    
                                    
5.        CONFIRMATION OF PASSENGER NUMBERS. We require a sales update of rooms sold and passenger numbers 12 weeks prior to arrival. At 8 weeks prior to arrival we require a provisional rooming list with any special rooming or dietary requests. At 6 weeks prior to arrival we require an updated rooming list with any special requests. A final rooming list with room and dietary requests is required no later than 4 weeks prior to arrival. All unsold room allocation will be automatically released unless agreed by the hotel, in writing. Any further room requirements would be on a request basis only. Failure to meet the above requirements could result in us cancelling the group reservation.                                            
                                        
6.        CANCELLATIONS. The latest date you may cancel an entire group (or any individual room booking within the group) without charge is 29 days prior to the arrival of the group.        
Group cancellations advised 14 – 28 days prior to arrival will be subject to 50% of agreed charge for group numbers booked.                                        
Group cancellations advised 7 – 13 days prior to arrival will be subject to 75% of agreed charge for group numbers booked.                                        
Group cancellations advised less than 7 dates prior to arrival will be subject to 100% of agreed charge for group numbers booked.                                
                                        
7.        PORTERAGE. Assistance will be made available to the group on arrival and departure and is included in the group rates agreed. In the interest of the health and safety of our employees, we will provide porterage for one suitcase per client with a weight limit of no more than 18 kilos, and unfortunately clients will be refused porterage if their suitcases exceed our porterage limits    
                                    
8.        CHILD PRICING. Children (12 years or under) are accommodated free of charge when sharing with 2 full paying adults, however meals for children will be charged as taken.            
                                    
9.        MEAL ARRANGEMENTS. All of your guests will receive a full Scottish breakfast. Your guests may make dinner reservations in either our Boatshed Restaurant or our HS-1 Café Bar (maximum 6 persons per table) .  We can supply a PDF of our current  A la Carte menus upon request. Your guests are required to settle their restaurant bill at the end of their meal. Payment may be made by cash or credit card.                                            
                                    
10.     OVERBOOKINGS/OUTBOOKINGS. Although every effort will be made to avoid any out-bookings, we do retain the right to out-book guests in exceptional circumstances. You will be informed, in writing, of any potential out-bookings at least 8 weeks prior to arrival. We will ensure that the alternative accommodation used is of the best quality available.                
                                    
11.     CONFIDENTIALITY. No part of our contract/dealing with you may be discussed, shown to, or in any other way disclosed to any third party.                            
                                    
12.    PAYMENT.  Our invoice for this group booking must be settled in full within 28 days of this group’s departure date. Should our invoice remain unpaid after 28 days from this group’s departure date, we reserve the right to withdraw our credit facilities and require pre-payment in full for all of the subsequent group arrivals that you have booked with us. Should we exercise this right, such prepayments must be received by us no later than 7 days prior to the arrival dates of the remaining groups you have booked with us. Should we not receive any such pre-payment required by 7 days prior to the group’s arrival date, we reserve the right to cancel the group booking concerned, without prior notice.        
Your credit account is subject to an overall credit limit of £xx,000. Should the total of the projected cost of this group booking, plus the balance on your credit account at that time, be in excess of your credit limit, we reserve the right to require pre-payment in full for this group booking. Such pre-payment must be received by us no later than 7 days prior to this group arrival date. Should we not receive pre-payment in full by 7 days prior to this group arrival date, we reserve the right to cancel this group arrival without prior notice.

PAYMENT.  This group arrival requires to be pre-paid in full no later than 7 days prior to the group arrival date. Should we not receive pre-payment in full by 7 days prior to group arrival date, we reserve the right to cancel  this group arrival without prior notice.
    
13.     TAXATION. We reserve the right to change the contracted rate of V.A.T. in accordance with any future changes in the V.A.T. rate. All rates agreed are exclusive of Tourist Tax or any other Local Tax. Any such tax that we are obliged to charge in addition to the rates agreed will be payable by you, the contracted operator.
